These Terms and Conditions ("Terms") govern your use of radwebmarketing.com (the "Site") operated by ARK Media, Inc., doing business as RAD Web Marketing ("we," "us," or "our"). By accessing or using the Site, you agree to be bound by these Terms. If you don't agree, please don't use the Site.

If you become a client and engage us for services, separate written agreements (such as scopes of work, statements of work, or service agreements) will govern that engagement. These website Terms apply to your use of the Site itself.

  • Case studies and testimonials. Any case studies, testimonials, statistics, or examples shown on the Site reflect specific client situations and are not promises of similar results for your business.
  • Website uptime and performance. For websites we build or host, we work with reputable hosting providers but cannot guarantee uninterrupted uptime or performance, since hosting providers, internet infrastructure, and external services are outside our direct control.
  • Compliance services context. If you engage us for compliance-related services (such as ADA accessibility, CIPA, CCPA, or similar consultations), our work is intended to reduce your exposure and improve your alignment with applicable best practices and laws. We are not a law firm and do not provide legal advice. For legal questions specific to your business, consult a licensed attorney.

These Terms are governed by the laws of the State of California, without regard to its conflict of laws principles. Any dispute, claim, or controversy arising from or relating to these Terms or your use of the Site will be resolved exclusively in the state or federal courts located in Sonoma County, California. You consent to the personal jurisdiction of these courts and waive any objection to venue.

16. Informal Resolution First

Before initiating any legal action, you agree to first contact us in good faith to try to resolve the issue informally. Send a written notice describing the dispute to info@radwebmarketing.com or our mailing address below. We'll work with you in good faith to attempt resolution for at least 30 days before any formal action.

17. Time Limit on Claims

Any claim arising from or related to these Terms or your use of the Site must be brought within one (1) year of the events giving rise to the claim. After that period, the claim is permanently barred.

18. Class Action Waiver

To the fullest extent permitted by law, you agree that any dispute will be resolved on an individual basis only, not as part of a class, consolidated, or representative action.

By using the Site or contacting us, you consent to receive electronic communications from us (such as emails and notifications). You agree that any agreements, notices, or other communications we provide electronically satisfy any legal requirement that such communications be in writing.
